Protection for Vulnerable Youth

Special Immigrant Juvenile Status (SIJS) is a humanitarian immigration option for children under 21 who have been abused, abandoned, or neglected by one or both parents. This visa provides a pathway to lawful permanent residence and protects children from being returned to unsafe situations.

WHAT IS SIJS?

SIJS is available to undocumented children who:

  • Are under 21 years old and unmarried
  • Have been declared dependent on a juvenile court or placed under the custody of a state agency or individual
  • Cannot reunify with one or both parents due to abuse, neglect, abandonment, or a similar basis under state law
  • Would face harm if returned to their home country

Key Benefits

In Texas, obtaining SIJS often requires filing a SAPCR case in family court. A SAPCR is a legal proceeding that establishes custody, conservatorship, or guardianship of a child. This court order is critical to prove that:

  • The child has been placed under the care of an adult or agency
  • Reunification with one or both parents is not viable
  • It is in the child’s best interest to remain in the United States

The Process — Step by Step
